In March this year, an Argentine court held a trial of the death of football legend Maradona, and seven medical personnel were charged with "manslaughter" for misconduct during the treatment process.
However, just over two months later, the case caused another stir and was forced to enter the "retrial" process.
On November 25, 2020, Maradona, then 60, died suddenly in Buenos Aires, the capital of Argentina, which sparked condolences for fans around the world.
The autopsy results released by the Argentine police and procuratorate showed that the King of Football died of heart failure. In 2021, the Medical Committee ordered to investigate the incident determined that Maradona's medical team had "inappropriate, inadequate and reckless disposal behavior", and Maradona's family took the medical team to court.
In March this year, more than four years after Maradona's death, the case finally began to be heard. Maradona's medical team has been accused of "manslaughter", and the case has been held for 21 hearings so far and 44 witnesses have testified.
The Maradona medical team involved in the case consisted of eight people, of whom seven were prosecuted, but they generally denied the allegations.
The seven people indicted include neurosurgeon Leonardo Luke, a private doctor for the last four years of Maradona's life, and he performed a cerebral thrombectomy for Maradona weeks before his death.
There are also psychiatrist Agustina Kosachev (who prescribed a pre-diligence medication for Maradona), Nancy Forini (coordinator of the medical company hired during Maradona's hospitalization), and Dr. Pedro di Spania (supervising Maradona's treatment).
The indicted nurse Gisera Madrid will be tried later this year.
Accorded to 8 to 25 years in prison if convicted, according to Argentina media reports.
According to the plan, the trial will last for four months and the trial results will be released in July.
However, unexpectedly, a few days ago, there was a major change in the trial of the case, and the one who led to this major change actually caused serious violations of the law by one of the three judges responsible for hearing the case.
The violation judge is named Hulieta Makintachi, 46 years old. Her violation was "participated in the shooting of a documentary."
The documentary, titled "Divine Justice", covers the entire process from the death of Maradona, to the beginning of murder suspicion, to the beginning of the trial.
In a nearly two-minute trailer released first, archival footage of Maradona's goal was interspersed with footage of Makintac walking in high heels and short skirts in Buenos Aires court corridor, various string soundtracks also enhance the suspense.
In the video, Makintach looked at the camera and asked with a smile, "What else do you want me to do?"
In another scene, the photographer asked Makintach to organize his hair and introduce himself, while she faced the camera to describe her nervousness when she was about to step into court and prepare to participate in this high-profile trial.
According to Argentine media reports, "Divine Justice" was not filmed recently, but was prepared and produced before the case officially opened in March.
As the documentary trailer spread, people realized that the female judge was using the trial of Maradona to market herself.
After watching the preview of this documentary, Patricio Ferrari, the prosecutor in charge of this case, said bluntly that Makinati "like an actress, not a judge"!
What made Argentine legal professionals feel even more embarrassed and angry was that the shooting of "Divine Justice" used recordings of the relevant trials, but did not receive any authorization and did not report to the court. It was completely secretly completed by the shooting team.
With the deepening of the media, people have found that Makintachi's appointment as one of the presiding judges in the case of Maradona was not through the lottery or assignment procedures that the court should have, but the result of her personal active application.
This led to the outside world further deeming that Makintachi had planned to pass the Maradona case and market himself in the form of a documentary.
In response to this, Fernando Burlando, the attorney for Maradona's daughter, said in great angrily:
In the past ten days, our focus has been no longer on the murderers who caused Diego's death, but has been evaluating the situation of Judge Makintage.
This is not a trivial matter, we have seen Diego suffer abuse while he was being treated, and now we are seeing the judicial system playing and abuse him and his entire family.
With the leak of the documentary promotional video, Makintach was asked to evade without surprise, and then the Supreme Court of Buenos Aires Province issued an injunction to confirm that she would be ordered to "take a leave" for 90 days.
However, Makintage defended herself, saying, "My impartiality is not threatened, there is no suspicion of lack of neutrality, because there is no sign of this. I regret this result."
At a previous hearing, Makintage had stated that her brother was a partner in the documentary production company, but that had nothing to do with "Divine Justice".
Based on Makintachi's behavior, the fairness of the court was questioned, and she was asked to avoid the case, which led to the deconstruction of the "three judges" in the trial, so the trial naturally could not continue.
As the other two judges who tried this case declared that the trial of this case was invalid, a retrial will be conducted, and everything will return to the original point..
According to the Outlet, the case will be retried by a new panel of judges, but it is not clear when the new trial will begin, and by practice, the new date will be postponed to at least the first quarter of 2026. However, both the prosecution and the defense hope to speed up the relevant progress, hoping that the new court trial will be reopened at least by the end of this year.
In addition, prosecutor Patricio Ferrari suggested that the court should prepare four judges, and in addition to the three presiding judges, there is also one "substitute judge".
After all, there is a lesson from Ms. Makintachi, who knows what else will happen to be "small tricks"...
